TPS Update: Court Allows USCIS to End Work Authorization for Certain Beneficiaries

On July 21, 2026, the U.S. District Court for the District of Massachusetts issued an emergency stay that temporarily blocked U.S. Citizenship and Immigration Services (USCIS) from implementing policies that would have shortened the validity of certain TPS-based Employment Authorization Documents (EADs). That temporary stay allowed many TPS holders from El Salvador, Ukraine, and Sudan to continue working beyond July 22, 2026 or the current expiration date on their EADs while the court considered the case. However, on August 5, 2026, the court found that the plaintiffs were unlikely to succeed on the merits of their challenge and declined to continue the injunction. As a result, USCIS may now enforce its policy ending employment authorization for affected TPS beneficiaries.
